1. Heard the parties.
2. The petitioners apprehend their arrest in connection with Buxar (Industrial Area) P.S. Case No. 96 of 2025 dated 18.04.2025 registered under Section 127(2), 115(2), 109(1), 118(2), 303(2), 352, 3(5) of the B.N.S. 2023.
3. As per the prosecution case on 17.04.2025 in the morning
2/4 while the informant and her son was sitting near her house, her co-villager / petitioner no. 1 came and started abusing her son. It has further been alleged that petitioners and other accused persons armed with weapons surrounded her father-in-law and son and assaulted them. Babuwa Ram assaulted the father-inlaw of the informant by means of 'lathi' in his stomach and Vivek assaulted him by means of 'lathi'. The petitioner no. 1 assaulted her son by sword due to which he received injury in his finger. The petitioner no. 3 / Sangam Ram assaulted the husband of the informant by means of sword on the head. The petitioner no. 2 / Raju Ranjan assaulted the informant and her husband by lathi. Vivek and Vishal are alleged to have assaulted her cousin father-in-law namely Lal Daroga Ram.
4. Learned counsel for the petitioners submits that both the parties are co-villagers and next door neighbours and dispute between the parties arose due to quarrel between children. A counter case has been lodged by the side of the petitioners bearing Buxar (Industrial Area) P.S. Case no. 95 / 2025 (Annexure -2) against the son of the informant and others. Referring to the impugned order learned counsel submits that injuries sustained by the victims are mentioned therein and from perusal of the same it appears that all the injuries are simple in
3/4 nature. Injury sustained by Lal Daroga Ram is also simple in nature in his left forearm though it has been contended by the informant before the learned Sessions Judge, Buxar that injured Lal Daroga Ram died due to assault made by the accused persons but no petition for adding Section 103 of the B.N.S. has been filed by the I.O. Injury in the left forearm of Lal Daroga Ram cannot lead to his death. It appears that the side of the informant has filed Complaint Case No. 466 of 2025 before the C.J.M., Buxar regarding death of Lal Daroga Ram.
5. Learned counsel for the State submits that from perusal of the impugned order it appears that Lal Daroga Ram has died subsequently. Lal Daroga Ram has also sustained injury in his left forearm.

Regard being had to the submission made by the parties, taking into consideration the fact that both the parties are co-villagers, there is case and counter case between the parties and injuries sustained by the victims are simple in nature, accordingly, I am inclined to grant anticipatory bail to the petitioners.
7. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on
4/4 furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (Industrial Area) P.S. Case No. 96 of 2025 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023.
