2. The petitioners seek regular bail in a case registered for the offence under Sections 8(c), 21(b) of the NDPS Act.

3. 50.37 grams of brown sugar has been recovered from the pocket of petitioner no. 1 namely Lalan Mehta and 31.04 grams of brown sugar has been recovered from the pocket of petitioner no. 2 namely Suresh Mehta.

4. Learned counsel for the petitioners submits that the petitioners are quite innocent and have not committed any offence. They are in custody since 07.12.2024 and claim clean antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act, Purnea/concerned Court below in connection with Sarsi P.S. Case No. 227 of 2024 subject to conditions that:- (i). The petitioner no. 1 will mark his attendance at the Sarsi Police Station on every Sunday of each month and the petitioner no. 02 will mark his attendance at Forbesganj Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioners. (ii). Before accepting the bail-bonds of the petitioners, the court below will verify the antecedents of the petitioners. If the petitioners are found having clean antecedent, the bail-bonds of the petitioners shall be accepted. If the petitioners are found having criminal antecedent(s), their bailbonds shall not be accepted by the court below.
