JUSTICE ARUN KUMAR JHA ORAL ORDER 18-07-2024 The instant petition has been filed under Article 227 of the Constitution of India seeking direction for transfer if Matrimonial (Divorce) Case No. 124 of 2018 filed by respondent no. 2 under Section 13 of the Hindu Marriage Act and in the Court of learned Principal Judge, Family Court, Darbhanga to the appropriate Civil Court, Samastipur.

02. Such matters are required to be filed under Section 24 of the Code of Civil Procedure. Therefore, the petition under Article 227 would not lie in the matter.

03. Petitioner is permitted to convert the petition under Section 24 of the Code of Civil Procedure within two weeks.

04. Office is directed to extend all help towards conversion and thereafter matter be listed before appropriate roster Bench.
