2. The petitioner apprehends arrest in connection with Deoria (Dewaria, Deoriya) P.S. Case No. 245 of 2024 dated 25.10.2024 instituted for the offence punishable under Sections 126(2), 115, 118(2), 109, 352, 3(5) & 103 of the Bharatiya Nyaya Sanhita, 2023
3. The allegation against the petitioner is that, he along with other accused persons assaulted the son of informant by means of lathi, farsa, rod etc. as a result he sustained injury on his head.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this

There is no specific allegation against the petitioner rather the specific allegation is against co-accused Pradeep Rai, who is said to have assaulted the son of informant by means of iron rod due to which he sustained head injury. The allegation levelled against the petitioner is general and omnibus in nature. Further submission is that, informant and father of petitioner namely, Pradeep Rai are full brothers and due to pity dispute, all of sudden the occurrence took place. It is next submitted that there is only one injury on the head of the informant's son which is caused by hard and blunt substance. Lastly, it has been submitted that petitioner has no criminal antecedents.
5. Learned A.P.P. for the State and learned counsel for the informant vehemently opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Deoria (Dewaria, Deoriya) P.S. Case No. 245 of 2024, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten
