The petitioner apprehends his arrest in Aurangabad Town P.S. Case No. 525 of 2015 registered for the offences punishable under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code.
The informant alleged that while he was purchasing vegetables he came across with his friend in the meantime the petitioner and others came and abused the informant. It is further alleged that the petitioner assaulted the informant with bricks on his head.
It is submitted that no offence under Section 307 of the Indian Penal Code is made out. There was no intention to kill the
Patna High Court Cr.Misc. No.23618 of 2016 (3) dt.04-08-2016 2/2 informant.
Considering the facts aforesaid and the fact that on account of assault made by the petitioner with bricks the informant got grievous injury on his head, I am not inclined to enlarge the petitioner above named on anticipatory bail in Aurangabad Town P.S. Case No. 525 of 2015 pending in the court of the Chief Judicial Magistrate, Aurangabad. Accordingly, the same is rejected.
