Perused the impugned order dated 22.03.2016 passed by Subordinate Judge-X, Muzaffarpur in Title Suit No.139 of 2008 whereby the learned court below allowed the application filed by the plaintiff seeking permission to cross-examine the witnesses of the petitioner i.e. D.W.6 and D.W.7. From perusal of the impugned order, it appears that the court below has passed a reasoned order and, therefore, it cannot be said that the order passed by the court below is without jurisdiction or it has been passed in the manner not permitted by law. The court below has only allowed the plaintiff to crossexamine the witnesses. Thus, this is not a case for interference in exercise of
Patna High Court C.Misc. No.755 of 2016 (2) dt.29-09-2016 supervisory jurisdiction. Accordingly, this civil miscellaneous application is dismissed.
