====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 24-12-2021 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Town P. S. Case No.498 of 2021, instituted for the offences under Sections 414, 120B of the Indian Penal Code and Sections 30(A), 38(1), 41(1) of the Bihar Prohibition and Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 08.08.2021 and charge-sheet has been submitted in this case.

Allegation is of recovery of 3798.72 litre of liquor from a truck of which neither the petitioner is the driver, owner and cleaner of the truck.

Patna High Court CR. MISC. No.54536 of 2021(2) dt.24-12-2021 2/2 The learned counsel for the petitioner submits that petitioner had taken lift and was sitting in the truck when the raid was conducted and accordingly, he came to be implicated in the present case.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 08.08.2021 and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Trial Excise Court, Begusarai in connection with Town P. S. Case No.498 of 2021. The application stands allowed.
