The petitioner is apprehending his arrest in connection with Jagdishpur P.S. Case No. 277 of 2016 (G.R. No. 3923/2016) for offences under Sections 457 and 380 IPC and subsequently Section 491 of the Indian Penal Code was added. The case was registered against unknown. During the course of investigation stolen articles were recovered from the campus of the temple. The name of the petitioner surfaced in this case on the basis of confessional statement of co-accused Monu Kumar Jha and Pintu Kumar Singh.

In para-3 of the bail application the petitioner has stated that he has no previous criminal history. Nothing was

Having regard to the statements made in para-3 of the bail application that the petitioner has no criminal antecedent and nothing was recovered from the possessions of the petitioner, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. Case No. 277 of 2016 (G.R. No. 3923 of 2016), subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
