JUSTICE SUDHIR SINGH ORAL ORDER 05-07-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioners are apprehending their arrest in a case registered under Sections 342, 326, 307, 302, 498A/34 of the Indian Penal Code.

Allegation is that the accused persons including the petitioners committed torture and assault upon the victim due to non-fulfilment of demand of dowry and thereafter petitioners poured kerosene oil on the informant and set her on fire. It has been submitted on behalf of the petitioner that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the

Patna High Court Cr.Misc. No.22475 of 2018(4) dt.05-07-2018 2/2 present case. The petitioners are father-in-law and mother-inlaw of the deceased. They are separate in mess and property from the husband of the deceased. In paragraph Nos.44, 45, 46, 47 and 48 of the case diary, the witnesses have not supported the allegations made in the F.I.R.

On behalf of the State and learned counsel for the informant, it is submitted that the petitioners are named in the complaint case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Vaishali at Hajipur in connection with Tisiauta P.S. case No.44 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
