The petitioner seeks bail in a case instituted for the offences under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution allegation in short is that the accused persons, variously armed, shot fire at the wife of the informant due to which she lost her life.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.3.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The main allegation of assault is alleged against co-accused namely Shrawan Yadav who is
Patna High Court CR. MISC. No.41432 of 2019(2) dt.05-07-2019 2/2 alleged to have fired upon the deceased. As far as petitioner is concerned, he is alleged to have provided gun to the co-accused Shrawan Yadav. No allegation of assault is alleged against the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VI, Nalanda at Biharsharif in connection with Ben P.S. Case No. 36/19.
