The petitioner seeks bail in Paharkatta P.S. Case No. 46 of 2019 arising out of Special Case No. 167 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act.

It is alleged in the written report that 271 litres of foreign liquor has been recovered from Tempo. Petitioner is said to be driver of the aforesaid Tempo.

Counsel for the petitioner submits that petitioner has no concern with alleged foreign liquor and Tempo. The seizure list does not bear signature of the petitioner. He has been arrested merely on suspicion.

Petitioner is in custody since 30.5.2019 having

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge 2nd cum Special Judge, Excise, Kishanganj, in connection with Paharkatta P.S. Case No. 46 of 2019 arising out of Special Case No. 167 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
