The petitioner apprehends his arrest in connection with Riga P.S. Case No. 57 of 2021 registered under Sections 272, 273 and 414 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to dirty village politics and the biased intention. Further submission is that the name of the petitioner transpired on the first information report only on the basis of confessional statement of co-accused person. Petitioner has neither concern with the alleged motorcycle nor with the illicit liquor, as is evident from the seizure list. Further he

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the A.D.J.-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Riga P.S. Case No. 57 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
