Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 452, 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. Earlier the petitioner has been granted provisional bail vide order dated 02.03.2022 for two weeks on the ground that the mother of the petitioner had died on 20.02.2022. While granting the provisional bail to the petitioner, this Court had directed the learned court below to verify from the concerned police station that whether the mother of the petitioner had died nor not.

Patna High Court CR. MISC. No.45164 of 2022(2) dt.21-09-2022 2/2 Vide letter no. 1153 of 2022 dated 22.03.2022, the learned District & Sessions Judge, Araria has sent a report, annexing the report of the concerned police station which reveals that the mother of the petitioner had not died and the report also annexed the photo of the mother of the petitioner which shows that she is alive.

Considering the aforesaid, vide order dated 10.05.2022 passed in Cr. Misc. No. 69929 of 2021 the bail petition of the petitioner was rejected. The petitioner filed this petition for renew his prayer for bail in view of the reason recorded in the order dated 10.05.2022 passed in Cr. Misc. No. 69929 of 2021, the petitioner has misled this Court on the basis of false photo copy of invitation card of Shradh Ceremony of his mother.. In view of the aforesaid, I am not inclined to enlarge the petitioner on bail in connection with Sessions Trial No. 97 of 2022 arising out of Bhargama P.S. Case No. 162 of 2021 pending in the Court of learned Sessions Judge, Araria. Prayer is refused. (Rajesh Kumar Verma, J) Ibrar//- U T
