07-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Pipra P.S. Case No. 174 of 2021, registered for the offence under Section 414 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act. As per the F.I.R., this petitioner was apprehended with cash of Rs. 15,000/- (fifteen thousand), one live cartridge and one stolen motorcycle.

It is submitted on behalf of petitioner that the alleged motorcycle belongs to petitioner, as per Annexure - 2 the petition, which is a tax receipt of the vehicle issued in favour of petitioner and so far as recovery of Rs. 15,000/- cash is concerned, it is submitted that said amount was of petitioner and he was going to purchase mobile with said money. There is no recovery of any live cartridge from the conscious possession of petitioner. Petitioner is in custody since18.06.2021. Chargesheet has been submitted.

Patna High Court CR. MISC. No.55884 of 2021(2) dt.07-12-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Pipra P.S. Case No. 174 of 2021.
