2. The petitioner seeks regular bail in connection with Katra P.S. Case No. 403 of 2022, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per prosecution case, the deceased alleged to have been killed by the petitioner and other accused persons. Though, the petitioner is named in the F.I.R. as one of the assailants of the deceased. But during investigation it has come that one person like Chandan was seen running away. The deceased has been convicted of killing the father of the petitioner and false implication cannot be ruled out.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.45789 of 2023(2) dt.04-08-2023 2/2 petitioner is innocent and has falsely been implicated in this case. Petitioner is in custody since 03.02.2023.
5. Learned APP has vehemently opposed the prayer for bail.
6. Considering the aforesaid fact and also considering the period of custody, this application is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Muzaffarpur East, in connection with Katra P.S.
