JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 419, 420, 467, 468 and 120B and 34 of the Indian Penal Code.
Allegation is that petitioner is an agent of the Bajaj Allianz LIC Ltd. and he put a forged claim before the company on the basis of forged death certificate.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that F.I.R. itself shows that the company has not come to a conclusion as to who are involved in this case. Two cases were filed by company and accused in another case has been granted anticipatory bail.
Heard learned A.P.P. also.
Having heard both sides, in view of the submissions
Patna High Court Cr.Misc. No.17968 of 2017 (2) dt.02-05-2017 2/2 made above, petitioner above named shall surrender in the court below, i.e., A.C.J.M.-IInd , Saran at Chapra, in connection with Marhaura P.S. Case no. 15 of 2017 and learned Magistrate will release the petitioner on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) with two sureties of the like amount each to his satisfaction, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioner shall cooperate in the investigation and make himself available before the police as and when required. (3) if any incriminating article against the petitioner is found in course of investigation, prosecution is at liberty to move for cancellation of his bail bond.
With the aforesaid observation, this application stands disposed of.
