JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 31-10-2017 The husband of the petitioner died in harness on 25.01.2016 after serving for more than 30 years while being posted as Consolidation Officer, Piro, Bhojpur.

2. Originally, the grievance of the petitioner in the writ petition was that upon death of her husband, she has not paid the death-cum-retirement benefits.

3. A supplementary counter affidavit has been filed on behalf of the State stating therein that payments under the head death-cum-retirement gratuity, leave encashment and group

Patna High Court CWJC No.13443 of 2016 dt.31-10-2017 insurance have already been made to the petitioner. It is also stated that steps are being taken to redress the remaining grievances of the petitioner in respect of non-payment of provident fund and family pension. Learned counsel for the State categorically stated that the general provident fund and family pension dues shall positively be paid to the petitioner within six weeks from today.

4. Learned counsel for the petitioner also admits that payments under the head gratuity, leave encashment and group insurance have already been made to the petitioner during pendency of the writ petition.

5. Having considered the submissions made on behalf of the parties specially the undertaking given by the counsel for the State, the writ petition is disposed of directing the respondents to ensure that the payment of general provident fund and family pension is made to the petitioner within two months from today.
