JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-07-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 26.12.2020, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Dhanarua P.S. Case No. 448 of 2019, registered under Sections 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that in the evening of 28.10.2019 the informant was returning to his house then in the way Dablu Kumar abused him. When informant Ankit Kumar made protest, Dablu Kumar took out a pistol and made fire which passed nearby his tample region. On hearing hulla, his both brothers,

No.40461 of 2020(2) dt.23-07-2021 2/2 Abhishek Ranjan and Aditya Raj and mother, Sarita Devi reached there then Raj Kumar and Shrawan Kumar started abusing to his mother and brothers giving threatening to kill. On hearing hulla, when the villagers reached there they all fled away.

Learned counsel for the petitioners submits that the informant and the petitioners are co-villagers and due to dirty village politics petitioners have falsely been implicated in the case. Further submission is that the petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Subdivisional Judicial Magistrate, Masaurhi, Patna in connection with Dhanarua P.S. Case no. 448 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Vikash/- U T
