The petitioner seeks bail in a case registered under Sections 379/411 of the Indian Penal Code.
The prosecution case, in short, is that at the platform No. 3 at Muzaffarpur, as soon as the train started, the petitioner having taken the trolly bag of the informant kept beneath the seat, jumped from the train.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 09-03-2019. Charge sheet in this case has already been submitted. The petitioner has
Patna High Court CR. MISC. No.42215 of 2019(2) dt.09-07-2019 2/2 been falsely implicated in the present case. It has further been submitted that the petitioner may be released after completion of six months in custody.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that after completion of six months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Sonpur, Saran in connection with Muzaffarpur Rail P.S. Case No. 50 of 2019.
