This is a petition for grant of anticipatory bail for offence under Sections 420/34 of the Indian Penal Code and 7 of the Essential Commodities Act, 1955. According to first information report, rice was recovered from the shop-keeper. The villagers disclosed that the same was purchased from the petitioner no. 1, who was a public distribution system dealer.

Submission of the petitioners is that the first information report would reveal that from search of the public distribution system shop, no shortage of grain was found rather excess grain was there as the petitioner had brought the next installment of grains for distribution on 17.11.2016 itself.

Considering the aforesaid fact, the petitioners, above named, in the event of their arrest or surrender,

Patna High Court Cr.Misc. No.17187 of 2017 (2) dt.08-04-2017 2/2 within four weeks from the date of receipt of this order, be released on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Obra P.S. Case No. 147 of 2016 to the satisfaction of the Subdivisional Judicial Magistrate, Daudnagar, Aurangabad, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
