JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-03-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 409 and 420 of the Indian Penal Code.

Heard learned counsel for the petitioners.

It has been submitted on behalf of the petitioners that they have not deposited the amount due to the petitioners. Petitioner is ready to pay Rs 5, 55, 032/-.

Heard learned A.P.P. also. Nobody appears on behalf of the BSFC.

Having heard both sides, in view of the submission made by the learned counsel for the petitioners

Patna High Court Cr.Misc. No.8110 of 2017 (3) dt.02-03-2017 2/2 let above named petitioners surrender within a period of four weeks with a Bank Draft of Rs. 5,55,032/- and on submitting the aforesaid Bank Draft learned court below will release the petitioners on anticipatory bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) each with two sureties of the like amount each to its own satisfaction , subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioners shall cooperate in the investigation and make themselves available before the police as and when required.

In the meantime, till appearance before the court, no coercive steps shall be taken against the petitioners in connection with Kochadhaman P. S. Case 182 of 2016 pending in the court of Addl. Chief Judicial Magistrate, Kishanganj.

It is made clear that deposit of the aforesaid amount will be subject to the result of the final order of the case. This application is accordingly disposed of.
