The Petitioner apprehends his arrest in Rosera P.S. Case No.60 of 2016 instituted for the offence under Section(s) 304-B/34 Indian Penal Code pending in the Court of the Additional Chief Judicial Magistrate, Rosera, Samastipur. Petitioner is husband of the deceased. It is mentioned in the written report that the deceased had performed love marriage with this petitioner about four months prior to the occurrence. She was tortured in her Sasural for demand of dowry and for non-fulfillment of the aforesaid demand she was done to death on 07.11.2015.

Case diary has been received.

Learned APP has stated that it is mentioned in the

Patna High Court Cr.Misc. No.12978 of 2017 (3) dt.20-04-2017 2/2 Post Mortem Report that death has occurred due to burn injuries. In this manner, death of the deceased occurred in Sasural just after four months of her marriage due to burn injuries.

In view of such, this Court does not find it a fit case for grant of anticipatory bail.

Prayer is rejected.

The petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
