JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-06-2021 Heard Mr. Krishna Prasad Singh, the learned Senior Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Chand P. S. Case No.112 of 2020, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act.

It appears from the F.I.R. that 207 litres of liquor was recovered from a vehicle belonging to the petitioner. The learned counsel for the petitioner has submitted that the vehicle had been given to a driver to run it commercially with specific instructions that it should not be used for any unauthorized purpose. The driver of the vehicle acted truant and for that the petitioner ought not to be prosecuted.

No.40690 of 2020(2) dt.22-06-2021 2/2 Considering the afore-stated facts and taking into account that the petitioner has clean antecedents, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Kaimur at Bhabua in connection with Chand P. S. Case No.112 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
