JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-01-2024 The present writ petition has been filed seeking the following relief:- "1. For directing and commanding the respondent authorities to consider the case of petitioner for appointment to the post of Lekha Sahayak (IAY) pursuant to advertisement issued in the year 2013, petitioner had applied and is possessing requisite qualification and inspite of the fact recommendation was not made in favor of the petitioner and the persons having less marks than of petitioner is being considered for appointment."

At the outset, the learned counsel for the petitioner submits that in view of the stand taken by the Respondents in
Patna High Court CWJC No.16546 of 2021(2) dt.24-01-2024 2/2 paragraph no. 10 of the counter affidavit, filed in the present case to the effect that since the petitioner has obtained less marks than the successful candidates, his name has not been included in the list prepared by the Rural Development Department, Government of Bihar, Patna, by which candidates have been shortlisted for being considered for appointment on the post of Lekha Sahayak, the present writ petition has been rendered infructuous, thus, the same be disposed off. 3.
