The petitioner seeks bail in Ram Krishna Nagar P.S. Case No. 232 of 2019, instituted for the offence under Section(s) 376(g) of Indian Penal Code.
Counsel for the petitioner submits that victim girl has not levelled any specific allegation of overt act against petitioner in her statement recorded under Section 164 Cr. P.C. She has levelled allegation in her statement recorded under Section 164 Cr. P.C. against co-accused Rakesh and Raju. Counsel for the petitioner further submits that co-accused Rahul Kumar has already been granted bail by this Court vide order dated 16.7.2019 passed in Cr. Misc. 42690 of 2019. Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Sukul Ram, learned Sub Judge-XIII-cum ACJM, Patna, or his successor, in connection with Ram Krishna Nagar P.S.
