Mr. Syed Ehteshamuddin, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 20-05-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offence punishable under Section 366A of the Indian Penal Code.

The statement of the victim girl, recorded under Section 164 Cr.P.C., would reveal that the petitioner was known to her since last one month. On the inducement of the petitioner she went to Mumbai and the petitioner put vermilion on her head. However on the insistence of the victim she was made to return her parents' house. The petitioner is in custody since 19.03.2020.

Since the victim has not alleged anything more against the petitioner and it appears that the victim was a consenting party to go with the petitioner, let the petitioner,

Patna High Court CR. MISC. No.69 of 2021(4) dt.20-05-2021 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with POCSO Case No.76 of 2020, arising out of Imamganj P.S. Case No.40 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
