JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 07-01-2022 Heard the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Gopalganj Town P.S. Case No. 500 of 2019 instituted for the offences punishable under Sections 302/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the FIR has been lodged after two weeks. The specific allegation is against another person and the petitioner is said to be member of the mob, only without there being any specific overt act against him.
Taking into consideration the nature of allegation and death has been caused, it appears to be a mob lynching case, without commenting on further merits of the case, I do not find
