JUSTICE ARUN KUMAR ORAL ORDER 07-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 379, 411, 413, 414, 406 and 420/34 of the Indian Penal Code.
Allegation in brief is that the petitioner is indulged in committing theft of milk from Dairy tankers.
It is submitted that the seizure list clearly shows that the drum was not recovered from the Dhaba of the petitioner and except disclosure of petitioner's name by tanker driver, there is no material against the petitioner and he has no criminal antecedent. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Kari Singh @ Pankaj Singh be released on bail on
Patna High Court Cr.Misc. No.5554 of 2017 (2) dt.07-02-2017 2/2 furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No.415 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
