The petitioner seeks bail in Birpur P.S. Case No. 11/2018, instituted for offence under Section(s) 307, 397 and 427 of the Indian Penal Code read with Section 27 of Arms Act. Learned counsel for the petitioner has submitted that F.I.R. is against unknown. There is no recovery of any incriminating article from possession of this petitioner. No T.I.P. has been held in this case. Name of this petitioner has come in the instant case in the confessional statement of co-accused Mukesh Sahani, recorded in Birpur P.S. Case No. 13/2018. Thereafter the police recorded the confessional statement of

Patna High Court CR. MISC. No.42021 of 2019(2) dt.12-07-2019 2/2 petitioner in the instant case.

The other co-accused persons have already been granted bail by different Benches of this Court vide orders dated 28.11.2018 passed in Cr. Misc. No. 64866/2018, dated 18.01.2019 passed in Cr. Misc. No. 79312/2018. Learned counsel for informant has opposed the prayer for bail of petitioner.

Petitioner is in custody since 13.05.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Begusarai, in connection with Birpur P.S.
