Having regard to the limited prayer made by the petitioner in the present petition, I deem it fit and proper to dispose off the present case with liberty to the petitioner to file appropriate petition before the learned Court of Civil Judge-1st, (Senior Division), Rosera, Samastipur for expeditious disposal of the aforesaid Title Suit No. 124 of 2016, which shall be considered by the learned court below as per the prevailing exigencies.
