This application is for grant of regular bail in connection with Obra P.S.case No.217 of 2018 for the offences under Sections 302/34 of the Indian Penal Code. There is direct allegation against the petitioner of firing on the deceased causing his death.

Submission of the learned counsel for the petitioner is that there is no independent witness in this case. All the witnesses are family members. He is in custody since 4.10.2018.

Heard learned A.P.P. as well as the learned counsel for the informant.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant

Patna High Court CR. MISC. No.43942 of 2019(6) dt.02-03-2020 2/2 bail to the petitioner. Since the petitioner is in custody for more than one year, the learned trial court is directed to expedite the trial.

Accordingly, this application is dismissed.
