====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 19-03-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner has filed the instant application for grant of regular bail in connection with Minapur P.S. Case no. 228 of 2020 registered under sections 272, 273, 414 and 120B of the Indian Penal Code and sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016.
As per allegation in the first information report, 270 litres of IMFL was recovered from a truck and as per the statement of the local Chaukidar, he suspected that the same belongs to the petitioner.
It is submitted by learned counsel for the petitioner that the allegations as levelled in the first information report are false and incorrect. He has been falsely implicated at the instance of the Chaukidar. He has no concern either with the
Patna High Court CR. MISC. No.4 of 2021(2) dt.19-03-2021 2/2 seized truck or with the recovered incriminating articles. He has no criminal antecedent and is in custody since 18.8.2020. Chargesheet has been submitted in the case.
The application for bail is opposed by learned Additional Public Prosecutor for the State.
Having heard learned counsel for the parties and in the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Minapur P.S. Case no. 228 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur.
