The petitioner is in custody since 21.02.2023 in connection with Kharagpur P.S. Case No. 83/2023 registered for the offence punishable under Sections 341/323/376/506/34 of the Indian Penal Code.

The allegation against the petitioner is of committing rape upon a minor girl.

It has been submitted by the learned counsel for the petitioner that the petitioner has been falsely implicated in this case. It is further submitted that the girl appears to be a major in the medical examination.

No.45994 of 2023(2) dt.04-08-2023 2/2 In view of the aforementioned facts and circumstances and taking into consideration that as per the school certificate, the girl is a minor one, I am not inclined to release the petitioner on bail. It is, accordingly, rejected for the present.
