The petitioners seek bail in connection with Jamhore P.S Case No. 60 of 2019, dated 18.05.2019 (Sessions Trial No. 202 of 2019) instituted for the offences under Sections 341, 323, 307, 393, 34 of the Indian Penal Code.

Patna High Court CR. MISC. No.43044 of 2019(3) dt.27-09-2019 2/3 robbed and beaten up, the police arrived and arrested five persons whose names have been specifically stated in the F.I.R.

The petitioner was not arrested on the spot.

However, his name has transpired in the statement of those five arrested accused persons. Since the entire transaction took place in few minutes, the name of the petitioner has been arraigned as accused in the F.I.R. Nothing has been recovered from the possession of the petitioner and he has also not been put on Test Identity Parade. The police has submitted charge-sheet under Section 395 and 307 of the Indian Penal Code. The petitioner is in custody since 23.05.2019. Considering the aforesaid background of the petitioner, the petitioner, above named is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Aurangabad in connection with
