Petitioner seeks regular bail in connection with Sahebganj PS Case No. 198/2021 registered for the offence punishable under Sections 399, 402, 413, 414 of of the IPC and Section 25(1-b)a, 26, 35 of the Arms Act.
The police got an information that some miscreants with an intention to commit offence have assembled near Khursaida Urdu School proceeded towards the place of occurrence and upon seeing the police party five persons on two motorcycles tried to flee away. However, they were apprehended and upon search the police recovered fire-arms, cartridges, mobile phones etc., from other accused persons

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case due to oblique motive. He next submits that the petitioner has got no criminal antecedent and is in custody since 30.04.2021. Charge-sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidences if he is granted bail.
Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner has got no criminal antecedent, he is in custody since 30.04.2021, charge-sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidences if he is granted bail, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, MURAT KUMAR @ MURAT be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- 1st, West Muzaffarpur in connection with
