The petitioners apprehend their arrest in Sarairanjan P.S. Case No. 267 of 2012 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 380 and 504 of the Indian Penal Code.

As per the Fard-beyan, there is specific allegation of assault against co-accused Sanjay Thakur and Vijay Thakur who

Patna High Court Cr.Misc. No.13061 of 2017 (2) dt.24-03-2017 2/2 are not the petitioners herein. These petitioners are alleged to be the members of unlawful assembly.

From the written report it appears that the occurrence took place on account of land dispute between the parties. It is mentioned in paragraph-3 that the petitioners have clean antecedent.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today, in connection with Sarairanjan P.S. Case No. 267 of 2012, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
