The petitioner apprehends his arrest in Dehri Town P.S. Case No. 288 of 2016 registered for the offences punishable under Section 353 and other Sections of the Indian Penal Code, Section 04(1-a), 21(1)D.E. Act, 40(1) of the Bihar Mining Act, 33/41/42 of the Indian Forest Act and Section 47(a)(e) of the Bihar Amended Excise Act, 2016.
The informant alleged that on information he went to the place of occurrence, where many crusher machines were running for preparing chips but, the petitioner and others pelted stones on the police party.
Learned counsel for the petitioner submits that similarly situated co-accused Dinesh Kumar @ Dinesh Kumar Gupta and
Patna High Court Cr.Misc. No.16270 of 2017 (2) dt.28-04-2017 2/2 others have already been enlarged on anticipatory bail. The petitioner is named in the FIR only because he runs a society of crusher mill owners. No specific allegation is made against the petitioner and the license was granted for twenty years. Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Dehri, Rohtas in Dehri Town P.S. Case No. 288 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
