2. In the present case, the petitioners seek bail in connection with Meskaur P.S. Case No. 54 of 2025 registered for the alleged offences under Sections 115(2), 126(2), 118(1), 103(1), 3(5) of B.N.S., 2023.

3. As per prosecution case, in the background of land dispute, the petitioners and other co-accused persons made scuffle with the informant side and co-accused Chandradeo Chaudhary assaulted the father of the informant with garasa causing his death. They also assaulted one Chhotu Chaudhary.

4. Learned counsels for the petitioners submit that the petitioners are innocent and have been falsely implicated in this case. The petitioners and the informant side are agnates and land dispute is admitted. There is no eye witness to support the prosecution case and the petitioners have no motive or intention to commit the offence. Learned counsel further submits that the specific allegation of assault on deceased Saryu Chaudhary is against co-accused Chandradeo Chaudhary. Petitioner Usha Devi is a lady and she was not even present at the place of occurrence. The petitioners are in custody since 29.03.2025 and they are having clean antecedent. Charge sheet has been submitted.

5. Learned APP opposes the submission made on behalf of the petitioners.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering nonspecific nature of allegation against the petitioners, period of

No.43343 of 2025(2) dt.16-07-2025 3/3 custody of the petitioners and submission of charge sheet, the petitioners above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Nawada/concerned Court in connection with Meskaur P.S. Case No. 54 of 2025, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions :

(i) One of the bailors will be a close relative of the petitioners.

(ii) The petitioners will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the court concerned.
