Petitioner is apprehending his arrest in connection with Special POCSO Case No.33 of 2019 , registered for offences punishable under Sections Alamganj P.S.case No.145 of 2019 dated 22.2.2019 of the Indian Penal Code.

As per the FIR, it is alleged that the petitioner has obstructed the informant and tried to molest her on the way. Submission of the learned counsel for the petitioner is that the allegation is false and concocted and they are in the habit of lodging such type of cases, as there is land dispute between the parties, which will appear from the materials available in the case diary and earlier also the cousin sister of the informant has lodged such a case in which the petitioner

Patna High Court CR. MISC. No.41845 of 2019(4) dt.27-09-2019 2/2 has been granted privilege of the anticipatory bail and the independent witnesses have also not supported the prosecution case.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge- I cum Special Judge, CBI-II, Patna in connection with Spl. POCSO Case No.33 of 2019 arising out of Alamganj P.S.Case No.145 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
