A supplementary affidavit has been filed on behalf of the petitioner. The same be kept on record.

Learned counsel for the petitioner is permitted to make necessary correction in paragraphs 1 and 4 of the main bail application in course of the day.

Learned counsel for the petitioner is directed to remove the defects, as pointed out by the Office, within a period of four weeks.

The petitioner is apprehending his arrest in a case registered under Sections 386, 504, 509 of the Indian Penal Code, section 27 of the Arms Act, and sections 66E and 67 of the I.T. Act. The prosecution allegation, in short, is that the petitioner took photos of the informant and converted it into obscene image.

No.54388 of 2021(3) dt.09-03-2022 2/2 It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner lent some money to the informant and when he demanded it back, the informant refused to make payment and to save his own skin, got the present case instituted. Prior to the institution of the present case, a sanha was lodged against the informant and his family members.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Rampur P.S. Case No. 163/2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
