JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-11-2017 Heard, Mr. Chote Lal Mishra, Mr. Prithvi Raj Singh learned counsel for the petitioner, learned A.P.P. for the State and also learned counsel for the opposite party no. 2. The petitioner apprehends his arrest in connection with Complaint Case No. 26 of 2015, registered under Section 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioner and opposite party no. 2 jointly submits that the matter was referred to the Mediation Centre, Patna High Court, for settlement of the dispute in between the petitioner and the complainant-opposite party no.2, who are the husband and wife, where the dispute could not be settled. While on intervention of well-wisher of both parties, the matter

Patna High Court Cr.Misc. No.17895 of 2017 (5) dt.15-11-2017 has been settled out of court amicably and accordingly petitioner and the complainant-opposite party no. 2 are ready to lead their conjugal life. A supplementary affidavit has been filed in that regard signed by the complainant- opposite party no. 2 and the petitioner.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Aurangabad, in connection with Complaint Case No. 26 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
