The petitioner seeks bail in a case registered under Sections 341, 323, 376, 313, 34 of the Indian Penal Code. Prosecution case in short is that there was a love affair was going on between the informant and the petitioner for two years. Allegedly, the petitioner called the informant on the assurance that he will take the victim-informant to Ludhiyana. The victiminformant came on the road and waited but the petitioner could not come there.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 25-05-2019. Charge sheet has

On the false pretext of marriage, the petitioner established physical relationship with the informant. There is no medical examination report in support of offence under Section-313 of the Indian Penal Code. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua (Mahila) P.S.
