2. The petitioner apprehends his arrest in connection with Sandesh P.S. Case No. 114 of 2024 dated 27.04.2024 registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1B)(a), 26 and 35 of the Arms Act.

Learned counsel appearing for the petitioner submits that the petitioner is a young person and his name transpired in the present case on disclosure made by co-accused namely Ravi Shankar Kumar who was apprehended at the spot and the petitioner is at inimical terms with him and the alleged articles were recovered from the possession of said co-accused

No.50324 of 2024(2) dt.21-08-2024 2/3 and the petitioner has no concern with the alleged arms, live cartridges and magazine that has been seized by the police and even the alleged motorcycle does not belong to the petitioner and he is a student and has got fair and clean antecedent.

4. Learned APP for the State has opposed the prayer for bail.

Having considered the above submissions and mainly the facts that the petitioner is said to be a 20 year old person and his name was disclosed by the apprehended coaccused Ravi Shankar Kumar with whom he is at inimical terms as per the statement made in paragraph '10' of the petition, and also, taking into account the petitioner's fair and clean antecedent and his plea that he has no concern with the alleged motorcycle which is said to have been recovered from the place of occurrence with other alleged articles, in my opinion, it is a fit case for grant of anticipatory bail to the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Sandesh P.S. Case No.
