In this case, the petitioner is seeking anticipatory bail in connection with Minapur P.S. Case No.393 of 2015, registered for the offence punishable under Sections 376/363(A) of the Indian Penal Code.
A complaint case has been filed by Sawitri Devi, making allegation that on 20.08.2015 her minor daughter has been kidnapped by the petitioner and in spite of search, she could not be traced out. Later on, the girl has been recovered. There is no specific allegation against the petitioner in the statement recorded under Section 164 of the Cr.P.C.
Patna High Court Cr.Misc. No.20985 of 2017 (2) dt.10-07-2017 2/2 Looking to the nature of allegation and the facts and circumstances of the case, let the petitioner-Neelam Devi, be released on bail in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Minapur P.S. Case No.393 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
