2. The petitioner apprehends his arrest in connection with Gaighat P.S. Case No. 235 of 2020 for the offence registered under sections 304(B), 328/34 IPC lodged on 10.08.2020 by the informant, Naisul Ansari.

3. As per the prosecution story, the informant alleged that the lady was married to this petitioner but was always tortured for dowry and in the night of 5th of August, 2020, they poisoned her. At the time of the death, she was carrying pregnancy of three months. This led to the FIR.

4. Learned counsel for the petitioner submits that the petitioner has been implicated only because the girl had snake bite during the rainy season which unfortunately has not come

5. Learned APP on the other hand has taken this Court to learned Sessions Judge order to show that that the matter is of the year 2021, he is the husband, twice he moved before the learned Sessions Judge and on the second occasion, the fact that earlier the anticipatory bail application was rejected, was concealed.

6. Considering the submissions of the parties as also the materials on record, in the opinion of the Court, it would be appropriate that he seek bail.
