Perused the impugned order dated 28.03.2016 passed by learned Munsif, Jamui in Title Eviction Suit No.2 of 2009 whereby the learned Court below deleted the name of some of the defendants including the present petitioner.

From perusal of the impugned order, it appears that the Court below has clearly recorded finding that the defendant including the petitioner whose names have been deleted are neither necessary party nor proper party. In view of the above clear finding recorded by the Court below and in view of the fact that the plaintiff has filed the suit for eviction for vacating the tenants in the suit preemies, I do not find any reason to interfere with the impugned order in exercise of supervisory jurisdiction.
