JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 25-10-2021 Heard learned counsel for the petitioner, learned counsel for the complainant and learned APP for the State. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection wtih Complaint Case no. 2177-C of 2019 instituted for the offence under Sections 498A and 323 of the Indian Penal Code. As per allegation in the Complaint petition, petitioner along with his family members have tortured the complainant in various ways for non-fulfillment of demand of Rs. 2 lac as dowry.

It is submitted by learned counsel for the petitioner that petitioner is husband of the complainant and has been falsely implicated in this case. In fact, petitioner is ready to keep

Learned counsel for the complainant has submitted that complainant is not ready to leave with her husband. She is ready for one time settlement.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Complaint Case no. 2177-C of 2019, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Danapur subject to the conditions as laid down under section 438(2) of the Cr.P.C.

Petitioner is directed to co-operate for settling the matter in peaceful manner before the concerned Family Court. (Sunil Kumar Panwar, J) sushma/- U T
