The order dated 23rd of September, 2015 passed by the learned Single Bench in Civil Review No. 133 of 2015 declining to review the order dated 6th of February, 2015 is subject matter of challenge in the present appeal. The learned Single Bench in the order under appeal found that there is no error apparent on the face of record.

3. The order dated 6th of February, 2015 is not the subject matter of challenge in the present Letters Patent Appeal. The learned Single Bench has set aside the process of allotment of dealer of kerosene oil at Jalalpur in the district of Saran vide the said order and directed that a fresh advertisement be published by giving benefit of age relaxation only to the writ applicants to participate in the interview.

4. Such direction was issued in view of the fact that the first advertisement for appointment of a dealer of kerosene oil was published on 9th of May, 2000. The allotment became subject matter of challenge on a number of occasions and for 15 years the matter could not be decided. Thus it was ordered that a fresh selection process be carried out after inviting fresh applications.

5. We do not find any error in the order passed by the learned Single Bench in review which may warrant interference in the present Letters Patent Appeal. The same is accordingly dismissed. (Hemant Gupta, ACJ) (Vikash Jain, J) AFR/NAFR NAFR CAV DATE N.A.
