JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-06-2017 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Bhagwanpur P.S. Case No. 118 of 2016 for offences under Sections 341, 447, 323, 307, 385, 379, 354/34 of the Indian Penal Code.
From perusal of the FIR, it transpires that the petitioner and several others armed with various weapons visited the residence of the informant and demanded Rs. 5,000/- and allegedly assaulted the informant and others. From perusal of the order of the Sessions Judge, Hajipur, it appears that other co-accused Jaybind Kumar, against whom there is allegation of assault by Lathi, was granted anticipatory bail.

No.20250 of 2017 (2) dt.06-06-2017 2/2 In para-9 of the petition it has been stated that charge sheet has been submitted in this case on 31.8.2016 under Sections 341, 447, 323, 308, 354/34 of the Indian Penal Code. In para-3 of the petition the petitioner has stated that he has no criminal antecedent.
Having regard to the fact that charge sheet has been submitted in this case under Sections 341,447, 323, 308 and 354/34 IPC as stated in para-9 of the petition and the fact that other co-accused has been granted anticipatory bail, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate 3rd, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 118 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
