1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 379, 504 and 506 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that while she had gone to attend the call of nature when Vinay Paswan came, acted inappropriately on which she

No.44145 of 2025(2) dt.16-07-2025 2/3 objected thereafter the accused persons including the petitioners came and Chinta Devi (petitioner no. 1) is alleged to have assaulted the daughter-in-law of the informant by brick causing injury on her waist and hand. Thereafter, Mahendra Paswan (petitioner no. 2) assaulted Mukesh Kumar with lathi on account of which he sustained head injury. Further, Anita Devi (petitioner no. 3) snatched the mobile of the informant and Ramishwar Paswan (petitioner no. 4) assaulted Raj Kishore Paswan by an iron falas as a result of which he sustained head injury. Further, Niraj Kumar (petitioner no. 5) assaulted the sister-in-law of the informant by lathi causing injury on temporal region and hand and Kanti Devi (petitioner no. 6) is alleged to have snatched gold ornaments of the informant.
4. Learned counsel for the petitioners submits that the entire family has been implicated in the instant FIR. It is further submitted that the dispute arose on the issue of cremation when the side of the informant became aggressor and assaulted the side of the petitioners for which Konch P.S. Case No. 248 of 2023 has been instituted, as such, the instant FIR has been instituted by way of counterblast. It is next submitted that even the injury suffered on both sides is simple in nature.
5. Learned A.P.P. for the State opposes the prayer for
Patna High Court CR. MISC. No.44145 of 2025(2) dt.16-07-2025 3/3 anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Konch P.S. Case No. 249 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
